YOU ARE ADVISED TO READ AND UNDERSTAND THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY BEFORE USING WWW.OCTAKIDZ.COM. CURIOSITY QUEST PRIVATE LIMITED (OPERATING UNDER THE BRANDNAME OCTAKIDZ), IS AN EDTECH COMPANY, INCORPORATED IN INDIA, FOR IMPARTING LEARNING. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO COMPLY WITH AND BE BOUND BY THESE TERMS. THESE TERMS ARE TO BE READ ALONG WITH THE PRIVACY POLICY AND ANY OTHER POLICIES ON THE WEBSITE.


1. Use by Children Under 18

Eligibility: octakidz.com is designed for users between the age of 9 and 18 ("Children"). However, users under 18 must access the platform under the supervision and consent of a parent or legal guardian.

Parental Consent: Registration and use of the platform by Children require verifiable parental consent. Parents or guardians must complete the registration process on behalf of their child.

Compliance with Laws: We adhere to the provisions of the Indian Contract Act, 1872, which stipulates that minors cannot enter into enforceable contracts. Therefore, all agreements on the platform are made with the parent or legal guardian.

Supervised Use: Parents or guardians are responsible for supervising their child's use of the platform and ensuring compliance with these Terms.

By completing registration, you consent to the use of AI-based tools for non-invasive academic evaluations as described in this policy.

2. Role and Responsibility of Parents/Guardians

Account Management: Parents or legal guardians must create and manage the account for their child. They are responsible for the accuracy of the information provided during registration.

Monitoring: Parents or guardians are expected to monitor their child's activities on the platform, including interactions and content accessed.

Compliance with Laws: We adhere to the provisions of the Indian Contract Act, 1872, which stipulates that minors cannot enter into enforceable contracts. Therefore, all agreements on the platform are made with the parent or legal guardian.

Liability: Parents or guardians accept full responsibility for their child's use of the platform and agree to indemnify Curiosity Quest Private Limited against any claims arising from such use.

3. General Terms

Account Termination: Curiosity Quest Private Limited reserves the right to suspend or terminate accounts found to be violating the Terms or engaging in misuse.

List of Violations That May Trigger Termination:

  • Abusive or Defamatory Content on Social Media or Public Forums: Any abusive, defamatory, or false statements made about the platform, its users, or employees on social media or public platforms.
  • Harassment or Abuse Within the Platform: Use of offensive, threatening, or abusive language towards other users, mentors, support staff, or employees within the platform’s interface (chat, feedback, discussion, etc.).
  • Unauthorized Sharing of Login Credentials: Sharing one licensed user account with multiple individuals (e.g., siblings, friends, or classroom groups) or any other violation of our one license–one user policy.
  • Plagiarism or Misuse of Intellectual Property: Downloading, copying, distributing, or reproducing platform content (worksheets, activities, videos, or proprietary frameworks) without written consent.
  • Attempt to Breach Platform Security: Any attempt to hack, alter, reverse-engineer, or disrupt the platform or its backend systems, including unauthorized access or manipulation of content.
  • False Information During Registration: Providing incorrect or misleading personal, academic, or contact information during sign-up or enrolment processes.
  • Misuse of Refund Policy or Repeated Disputes:
    Abusing the refund policy by raising repeated, invalid refund requests or disputing legitimate charges through the payment gateway or bank.
  • Violation of Indian Law or Platform Policy:
    Any activity that is unlawful under applicable Indian laws, including but not limited to violation of the Information Technology Act, 2000, cyberbullying, and unauthorized digital transactions.
  • Spamming or Promoting Third-Party Services:
    Posting or promoting external products, services, or links within the platform without prior permission.
  • Use of Offensive or Inappropriate Usernames/Avatars:
    Creating or displaying inappropriate names, avatars, or content deemed offensive, discriminatory, or misleading.

4. Data Processing

OctaKidz may use automated tools, including AI-based models, to evaluate uploaded content and learning progress. Details of how this data is handled can be found in the Privacy Policy.

5. Non-Commercial Use

Your use of our products, Website, Application and Services is solely for your personal and non-commercial use. Any use of the Application, Website, Services or products or their contents other than for personal purposes is prohibited. Your personal and non-commercial use of this Application, Website, products and/or our Services shall be subject to the following restrictions:

  1. You may not decompile, reverse engineer, or disassemble the contents of the Application and/or our Website and/or Services/products or modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Application and/or our Website and/or Services/products, or remove any copyright, trademark registration, or other proprietary notices from the contents of the Application and/or our Website and/or Services/products.

  2. You will not (a) use this Application and/or our Website and/or Printed material and/or any of our product(s) or Service(s) for commercial purposes of any kind; or (b) advertise or sell the Application or any products, Services or domain names or otherwise (whether or not for profit), or solicit others (including, without limitation, solicitations for contributions or donations) or use any public forum for commercial purposes of any kind; or (c) use the Application and/or Website/our products and Services in any way that is unlawful, or harms the Company or any other person or entity as determined by the Company.

  3. No User shall be permitted to perform any of the following prohibited activities while availing our Services:
    1. Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
    2. Stalking, intimidating and/or harassing another and/or inciting others to commit violence.
    3. Transmitting material that encourages anyone to commit a criminal offence, that results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
    4. Interfering with any other person’s use or enjoyment of the Application/Website/Services.
    5. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner; committing any act that amounts to infringement of intellectual property; or making available any material that infringes any intellectual property rights or other proprietary rights of anyone else.
    6. Making available any content or material that you do not have a right to make available under any law or contractual or fiduciary relationship, unless you own or control the rights thereto or have received all necessary consents for such use of the content.
    7. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
    8. Posting, transmitting or making available any material that contains viruses, trojan horses, worms, spyware, time bombs, cancelbots, or other computer programming routines, code, files or programs that may harm the Application/services, interests or rights of other users or limit the functionality of any computer software, hardware or telecommunications, or that may harvest or collect any data or personal information about other users without their consent.
    9. Accessing or using the Application/Website/Services/products in any manner that could damage, disable, overburden or impair any of the Application’s/Website’s servers or the networks connected to any of the servers on which the Application/Website is hosted.
    10. Intentionally or unintentionally interfering with or disrupting the services or violating any applicable laws related to the access to or use of the Application/Website/Services/products; violating any requirements, procedures, policies or regulations of networks connected to the Application/Website/Services/products; or engaging in any activity prohibited by these Terms.
    11. Disrupting or interfering with the security of, or otherwise causing harm to, the Application/Website/Services/products, materials, systems resources; or gaining unauthorized access to user accounts, passwords, servers or networks connected to or accessible through the Application/Website/Services/products or any affiliated or linked sites.
    12. Interfering with, or inhibiting any user from using and enjoying access to the Application/Website/Services/products, or other affiliated sites; or engaging in disruptive attacks such as a denial of service attack on the Application/Website/Services/products.
    13. Using deep-links, page-scrape, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to increase traffic to the Application/Website/Services/products; to access, acquire, copy or monitor any portion of the Application/Website/Services/products; or in any way reproduce or circumvent the navigational structure or presentation of the Application, or any content; to obtain or attempt to obtain any content, documents or information through any means not specifically made available through the Application/Website/Services/products.
    14. Altering or modifying any part of the Services.
    15. Using the Services for purposes that are not permitted by: (a) these Terms; and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction.
    16. Violating any of the terms specified under the Terms for the use of the Application/Website/Services/products.

6. Intellectual Property and Content Use

Intellectual Property Ownership:
All content available on the OctaKidz platform — including but not limited to activities, worksheets, lesson plans, illustrations, videos, audio, animations, design elements, assessment tools, and AI-generated feedback — is the exclusive intellectual property of Curiosity Quest Private Limited, protected under applicable Indian copyright, trademark, and intellectual property laws.

The structure, sequence, and learning methodology embedded in the OctaKidz platform are proprietary and must not be replicated, adapted, or redistributed in any form without prior written consent.

Permitted Use:
Access to OctaKidz content is granted strictly for the personal, non-commercial, educational use of the subscribed child under the supervision of their parent or legal guardian.

  • Users may not reproduce, copy, modify, publish, transmit, share, or distribute any content for commercial purposes, training, classroom use, or third-party benefit.
  • No portion of the content may be uploaded to external platforms, including not limited to WhatsApp, YouTube, or Google Drive, without permission.
  • AI-generated reports or feedback provided on the platform are for informational and developmental use only and may not be misrepresented as certification or academic evaluation.

7. Subscription Period & Access

Subscription Terms and Validity:

  • Annual Subscriptions (365 days from the date of activation)
  • Quarterly or Monthly Plans (as applicable and communicated at the time of purchase)

The subscription period begins from the date of successful payment or activation, whichever is later, and remains valid until the end of the selected period unless otherwise suspended or terminated under these Terms.

  • Subscriptions are non-transferable and tied to a specific user account.
  • No extension will be granted for unused portions of the subscription, unless platform access was interrupted by a verified technical issue.
  • If you cancel early, your access continues until the end of the billing cycle. No partial refunds are issued unless covered under our Refund Policy.
  • If automatic renewals are applicable in the future, prior notice and consent will be taken in accordance with RBI e-mandate rules.

Access and Multi-User Restrictions:

  • Each OctaKidz subscription is valid for use by a single registered child only. Use of the same login credentials by multiple children, households, or entities is strictly prohibited.
  • Sharing account credentials, streaming content in group settings, or replicating content for multiple learners from a single account will result in account suspension or termination.
  • Schools, educators, and coaching centres wishing to access OctaKidz materials must contact the company for appropriate licensing arrangements.

8. Indemnification

By using OctaKidz, you (as a parent or legal guardian) agree to indemnify, defend, and hold harmless Curiosity Quest Private Limited, its directors, employees, licensors, partners, and affiliates from and against any and all claims, liabilities, damages, losses, demands, costs, and expenses (including legal fees) arising from or related to:

  • Your or your child’s breach of these Terms & Conditions or any applicable law;
  • Any misuse of the platform, services, or licensed content by you or your child;
  • Submission of false information or impersonation;
  • Violation of the intellectual property rights or privacy rights of others;
  • Use of the platform for unlawful or unauthorized purposes;
  • Any content uploaded, submitted, or shared by you or your child that results in reputational or legal harm to OctaKidz or third parties.

This indemnity obligation will survive the termination of your account or use of the platform.

9. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the jurisdiction of courts in Chennai, Tamil Nadu, India.

10. Modifications

We may update these Terms at any time. Continued use of the platform after such changes constitutes acceptance.
